Description of Service

MoodPad is an emotion journaling application that helps you track and understand your emotional state through various input methods including text, voice, and music lyrics. The service uses AI to analyze emotions and integrates with Spotify to enhance the journaling experience.

User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to accept responsibility for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You must be at least 13 years old to use this service

Spotify Integration

When you connect your Spotify account:

• You grant us permission to access your Spotify data as described in our Privacy Policy
• You must comply with Spotify's Terms of Service
• You can revoke access at any time through the app settings or your Spotify account
• We are not responsible for any changes or interruptions to Spotify's API or services

Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Violate any laws in your jurisdiction
• Infringe upon the rights of others
• Transmit any harmful code or viruses
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service

User Content

You retain all rights to the content you create (journal entries, recordings, etc.). By using our service, you grant us a license to:

• Store and process your content to provide the service
• Use AI to analyze emotions from your content
• Display your content back to you

We will never share your personal journal entries with third parties without your consent, except as required by law.

Intellectual Property

The service, including its original content, features, and functionality, is owned by MoodPad and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Third-Party Services

Our service integrates with third-party services including:

• Spotify (music data)
• OpenAI (emotion analysis)
• Lyrics APIs (lyrics fetching)

These services are governed by their own terms and conditions. We are not responsible for their availability, accuracy, or functionality.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The service will be uninterrupted or error-free
• The emotion analysis will be accurate
• Defects will be corrected
• The service is free from viruses or harmful components

Limitation of Liability

IN NO EVENT SHALL MOODPAD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may delete your account at any time through the app settings.

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
